On December 8th, 2017, Yadkin Riverkeeper joined American Whitewater and the North Carolina Wildlife Federation in filing an amicus brief before the U.S. Supreme Court in State of North Carolina v. Alcoa Power Generating, Inc. et al. The brief encourages the Court to grant the State of North Carolina's Petition for Certiorari and review the Fourth Circuit's decision that held that Alcoa Power Generating, Inc. owned the riverbed underlying its Yadkin Hydroelectric Project. Alcoa has since sold the project to Cube Yadkin Generation, LLC. The amicus brief explains to the Court how the Fourth Circuit's decision disrupts 200 years of North Carolina title law, and as a result calls into question historic public access, enables Cube to exert greater control on the Yadkin's drinking water resources, and inhibits the public's ability to monitor the Yadkin for known pollution emanating from Alcoa's former aluminum smelting site. Alcoa and Cube have until January 7, 2018 to file a response.
